Application of Rates-Commodity - Rates named in tariff apply on household goods, viz: personal effects, furniture, baggage & property used or to be used in dwelling where part of the equipment or supply of such dwelling: furniture, fixtures, equipment, stock or supplies of stores, offices or other establishments.
Accessorial Services - Except otherwise provided herein, rates covering accessorial charges rendered by carrier are in addition to transportation rates named in tariff.
Agency commissions - A max of 10% of tariff charge may be paid to a referral service which has referred booking to Company as a commission on each booking.
Articles not accepted - Unless otherwise provided, the following property will not be accepted for shipment: bank bills, coins or currency, deeds, notes, drafts, or valuable papers of any kind, credit cards, jewelry, postage stamps, trading stamps, letters or packages of letters, precious stones or articles of peculiarly inherent or extraordinary value, precious metals, or articles manufactured there from or perishable articles. Should such articles come into possession of the carrier without its knowledge, responsibility for safe delivery will not be assumed.
Articles Liable to Cause Damage - Carrier will not accept for shipment property liable to impregnate or otherwise damage equipment or property. The carrier will not accept for shipment articles which cannot be taken from the premises without damage to the article or the premises.
Complete Article - Each Shipping piece or package and contents thereof shall constitute one article except the total component parts of any article taken apart or knocked down for handling or loading in vehicle shall constitute one article for the purpose of determining carrier's liability. When entire shipment is transported in containers/shipping boxes, each shipping pkg, piece or loose item not enclosed within a pkg in such containers or shipping boxes will constitute the article.
Declaration of Value - Shippers are required to state specifically in writing the agreed or declared value of the property, otherwise, a base value of 60 cents per lb. per article will apply. Where value in excess of 60 cents per lb. per article is declared, at shipper option, carrier will provide full declared value protection through special insurance at an added charge equal to required premium. In this instance, carrier represents BAKER INTL INSURANCE as an authorized rep/agt (add'l chg to customer). If shipper declines to declare value or agree to release value in writing, shipment may not be accepted. If accepted, base release value of 60 cents per lb. per article will apply.
Claims - Any claim for loss, damage or overcharge shall be in writing & shall be accompanied by original paid bill for transport & 2 estimates of repair/replacement. Carrier may require certified or sworn statement of claim. Carrier shall be immediately notified of all claims for concealed damage & shall be given reasonable opportunity to inspect alleged concealed damage in original package. Limitation of time for filing claim is 7 days. Carrier's liability shall not exceed cost of repair or replacing property lost or damaged with materials of like kind and quality not exceeding actual cash value of the property at time and place of loss, with due allowances for depreciation or deterioration howsoever caused, but in no event to exceed: the released value not exceeding 60 cents per lb. per article, if shipper has not released the value to a lump sum for the entire shipment, such proportion of the actual value of the article or articles lost or damaged as determined by any supplemental insurance the shipper may subsequently have purchased. The carrier's liability for goods shall cease when the property has been delivered to and receipted for by the owner, or consignee or shipper or authorized agent or either, except as to damage noted at time of delivery. When carrier is directed to unload or deliver property (or render any services) at a place(s) where consignee/agent is not present, the property shall be the risk of the owner after unloading or delivery. Where carrier is directed to load property from (or render any services at)a place(s) at which consignee or agent is not present, the property shall be at risk of the owner before loading. The carrier's liability with regard to sets or matched pieces shall be limited to repair or replacement of the lost or damaged piece(s) only and shall not extend repair, replacement or recovering of the entire set, but shall in no event exceed: the released value not exceeding 60 cents per lb. per article or if shipper has declared a value on the entire shipment, such proportion of the actual value of the article or articles lost or damaged as determined by any supplemental insurance the shipper may subsequently have purchased. The services in this tariff do not include the servicing of refrigerators, stoves, deep freeze cabinets, radios, record players, washing machines, dryers, television sets, air conditioners, television aerials or other articles or appliances requiring special servicing, prior to or immediately after transport. However, the carrier will, if requested by the shipper consignee or owner, and acting as designated agent for such party and at such party's sole and separate expense, attempt to engage competent and qualified third persons, if such persons be available, to service the aforesaid items, but the carrier assumes no responsibilities for the activities, conduct or competence of the aforesaid third persons, amount of their charges or quality or quantity of the service furnished, it is being understood that the prime & sole responsibility for servicing of any and all such articles as aforesaid lies with the shipper, and shipper shall have all such articles properly serviced immediately prior to transport, independently or through the carrier as it's designated agent, and the carrier shall not be responsible for examining the above mentioned articles to determine whether or not such articles have been properly serviced prior to or immediately after transport.
Claims for Lost or Damaged Freight or Baggage - A claim by a shipper or consignor against a common or motor carrier for lost or damaged freight or baggage must be submitted to the carrier within 7 days after the loss or damage is discovered. Within 14 days after receipt of the claim, the carrier shall either (a) compensate the shipper or consignor or (b) deliver to the shipper or consignor a written denial of the claim. A denial of the claim may be appealed by the shipper to the TSA.
Failure to Make Delivery - In all instances where carrier is unable to locate consignee at address given by shipper, or correct address (if known by carrier); or where the consignee is unable or declines to accept delivery of the shipment, or the shipment remains in the possession of the carrier pursuant to instructions of the shipper or consignee, notification of failure to make delivery will be mailed or telegraphed to the consignee, consignor or owner, or written notice delivered to the premises where actual delivery was to be effected or to other notifying address and the property placed in the nearest warehouse of the carrier, or at the option of the carrier, in a public warehouse, and upon such placement liability as a carrier shall immediately cease and liability shall thereafter be only that of the warehouseman in possession. In cases where a "subsequent delivery" is called for and made, charges will be assessed for "subsequent delivery" on the basis of charges lawfully applicable from carrier's terminal or from the public warehouse (as the case may be) to place of delivery.
Impracticable Pick-Up or Delivery - It is the responsibility of the shipper to make shipment accessible to carrier or accept delivery at a point which the road haul vehicle may be safely operated. When physically impossible for carrier to perform pick-up of shipment at original address or to complete delivery of shipment at destination address with normally assigned road haul equipment, due to structure of building, its inaccessibility by highway, inadequate or unsafe public or private roads, overhead obstructions, narrow gates, sharp turns, trees, shrubbery, the deterioration of roadway due to flood, snow, or nature of an article or articles included in the shipment, the carrier shall hold itself available at point of pick-up or tender delivery at destination at nearest point of approach to the desired location where road haul equipment can be made safely accessible. Upon request of shipper, consignee, or owner of goods, the carrier will use or engage smaller equipment than it's normal road haul equipment or provide extra labor for the purpose; if possible of accomplishment, of transferring the shipment between the residence and the nearest point of approach by the carrier's road haul equipment. Charges for this auxiliary service to cover labor and additional vehicle (if used) will be as provided in carrier tariffs and shall be in addition to all other transport or accessorial charges to the shipper. If shipper does not accept shipment at nearest point of safe approach by carrier's road haul equipment to the destination address, the carrier may place the shipment, or any part thereof not reasonably possible for delivery, in storage at the nearest warehouse of the carrier, or, at the option of the carrier, in a public warehouse subject to a lien for all lawful charges. The liability on the part of the carrier will cease when shipment is unloaded into the warehouse and shipment shall be considered as having been delivered. Transportation charges to cover movement of shipment or part thereof from point at which it was originally tendered to warehouse location shall constitute a new shipment, subject to applicable rate as provided in tariff from point at which it was originally tendered to warehouse location, which shall be in addition to charges to initial point of origin at which shipment was originally tendered. All accrued charges on the shipment or any part thereof shall be due and payable upon delivery of same to the warehouse. Any movement from warehouse shall constitute a new shipment.
Impraticable Operation - Nothing in this tariff shall require the carrier to perform any line haul service or any pick-up or delivery service or any other service from or to or at any point or location where, through no fault or neglect of the carrier, the operation of vehicles is impractical because: the conditions of roads, streets, driveways, alleys or approaches thereto would subject operations to unreasonable risk or loss or damage to life or property. Loading or unloading facilities are inadequate. Any force, majueure, war, insurrection, riot, civil disturbance, strike, picketing or other labor disturbances would subject operations to unreasonable risk of loss or damage to life or property or unreasonably jeopardize the ability of the carrier to render line-haul or pick-up delivery or any other service from or to at any points or locations.
Insurance - The cost of any insurance in the name of the shipper, for the benefit of the shipper will not be assumed by the carrier.
Marking and Packing - Articles of fragile and breakable nature must be packed properly. No claims will be allowed on any items that are not packed by the carrier. Where shipments are improperly, insecurely or unsafely packed, crates or boxed and by the reason thereof the contents may be destroyed or damaged, carrier will arrange to have such shipment properly packed, and charges shown in the carrier's tariff will be assessed. The shipper shall provide all original packing boxes or agree to use boxes as provided by the carrier. If shipper instructs carrier to pack or repack any item(s), those items must be unpacked by the carrier. No claims will be allowed on any items not unpacked by the carrier.
Payment of Charges - The carrier will not deliver or relinquish possessions of any property transported by it until all tariff rates and advance charges have been paid by cash, money orders, cashier's check, or Visa or Mastercard except where other arrangements have been made in advance. The carrier shall have lien rights on any property transported by it for all charges incurred. The shipper will furnish the carrier, upon demand, a certified statement describing and setting forth the actual value of any property in possession of carrier being held for payment. Transportation charges to cover the movement of shipment or part thereof from point at which it was originally tendered to warehouse location shall constitute a new shipment, subject to applicable tariff rates from point at which it was originally tendered to warehouse location, which shall be in addition to charges from initial point of origin to point at which shipment was originally tendered. All accrued charges on the shipment or any part thereof shall be due payable upon delivery of same to the warehouse. Any subsequent movement from warehouse shall constitute a new shipment. After 7 days, with proper notice, carrier shall have the right to sell, as shipper's agent, at public or private sale, any property of shipper in satisfaction of any charges not paid in full.
Pick-Up And Delivery At Warehouse - Except as otherwise provided herein, if shipment is delivered to or picked up at a warehouse, the rates for transport include only the loading and unloading at the door, platform, or other point convenient or accessible to the vehicle.
Shipments Accepted Subject to Laws - Shipments will be accepted subject to the requirements or ordinances or limitation of law regulating the transportation of the property, or use of the vehicles and facilities.
Waiting and Delays - When a vehicle is held for convenience of shipper or consignee through no fault of the carrier, a charge for waiting time will apply at the hourly rates shown.
Inspection of Packages - When the carrier or his agent believes it is necessary that the contents of packages be inspected, he shall make or cause such inspection to be made, or require other sufficient evidence to determine the actual character of the property.
Servicing Special Articles - The transportation rates in this tariff do not include servicing or unservicing articles or appliances such as refrigerators, deep freeze cabinets, radios, record players, washing machines television sets, air conditioners, and the like which, if not properly serviced may be damaged in, or incident to, transit; nor is liability assumed for any such damage unless said articles or appliances are serviced and unserviced as provided as follows. (a)Upon request of shipper, owner or consignee of goods, the carrier will subject to (b) below service and unservice such articles at origin and destination for the additional charge provided in tariff. Such servicing & unservicing does not include removal or install of articles secured to premises; or plumbing, electrical or carpentry services necesary to disconnect, remove connect and install such articles and appliances. (b) If carrier does not possess qualified personnel to properly service & unservice articles, appliances, etc, the carrier will, upon request of the shipper, owner or consignee, and as an agent for them, engage third persons to perform the servicing & unservicing. When 3rd persons engaged, the carrier will not assume any responsibility for their activities or conduct, amount of charges nor quality & quantity of service. All charges of 3rd persons must be paid by the shipper, and are in addition to all other charges in this tariff. In some cases, if necessary, such charges may be advanced by the carrier, and billed as an advance charge by the carrier to the shipper.
Advancing of Charges - Charges will be advanced by carrier for services of others engaged at the request of the shipper will be supported by the carrier with a copy of an invoice setting forth the services rendered, charges and basis thereof, together with references to applicable schedule of tariff. When 3rd persons are engaged by the carrier to perform any domestic or maid services, the carrier will not assume responsibility for their activities or conduct; amount fo their charge, nor for the quality or quantity of service furnished except as otherwise provided. The charges so advanced are in addition to and shall be collected with all other lawful rates.
Labor and Charges - Cover all accessorial services for which no charges are otherwise provided in this tariff, when services are requested by the shipper.
Early Termination of Shipment - The carrier reserves the right to stop work at any time and demand payment for time worked and time estimated to complete the shipment. The shipper reserves the right to stop work at any time, minimum charges still apply.
Application of Rates -Carrier charges tariff rates for all packing material/containers, which becomes property of customer. Charges for packing material/containers subject to state sales tax. (A) Applying to shipments having a point of origin and or destination within 85 miles of the main post office of the carrier’s base of operations. $75.00 pr hr ttl avg = Furnish Vehicles-each $35.00 pr hr; Driver/Mover-$20.00 pr hr; Packer/Unpacker/Mover-$20.00 pr hr; Hand Moving/Moving-$20.00 pr hr; Other Extra Help/Mover-$20.00 pr hr. Charges applied as follows: (1) If shipment has point of origin and point of destination with in the immediate 5 mile radius of the carrier’s base operations; hourly charges will apply from the point of origin to the point of destination. (2) If a shipment has a point of origin, and is within the 5 mile radius of the base operations of the carrier, and a point of destination outside the 5 mile radius of the base operations of the carrier, hourly charges begin at point of origin and end upon return to carrier’s dock as the point of destination. (3) If shipment has point of origin within 5 mile radius of the base operations of the carrier, and point of destination outside that 5 mile radius, within the State of Nevada, but does not exceed 85 air miles in distance, hourly charges begin at the point of origin and end upon return to carrier’s dock as the point of destination. (4) If a shipment has a point of origin outside 5 mile radius of the base operations of the carrier, and a point of destination within 5 mile radius of the carrier’s base operations, hourly charges begin at carrier’s dock as point of origin, and continue thereafter to shipment pickup point; charges end at point of destination. (5) If the shipment has a point of origin outside 5 mile radius of the base operations of carrier, and a point of destination also outside 5 mile radius of carrier’s base operations, hourly charges begin at carrier’s dock as point of origin and continue thereafter to shipment pickup point; charges end at carrier’s dock as point of destination. All shipments subject to two (2) hour minimum charge. All charges subject to minimum of two (2) persons/Movers and one (1) vehicle. Chargeable time commences upon arrival at point of origin. Chargeable time ceases upon departure from point of destination. (B) Overtime Rates–None. (6) Flat rates apply to shipments moving more than 85 air miles from the main Post Office of the Carrier’s base of operations. Rates include one (1) truck with two (2) Movers, loading and unloading and all driving times. Rates are applying to shipments having any point of origin and destination between any two points over 85 miles apart within the State of Nevada, or Inter-state. All Intra-State moves, under 85 air miles, are applicable to hourly rate charges outlined in this tariff. (7) 85–150 Air Miles-$1,200.00 (8) 150–200 Air Miles-$1,500.00 (9) 200–300 Air Miles-$2,000.00 (10) 300–350 Air Miles-$2,250.00 (11) 350+ Air Miles-$2,500.00 (12) Interstate flat
